Terms and Conditions

 

PRICING

All prices displayed are in New Zealand dollars and include all taxes.

Where a credit card is used for payment we do not charge additional fees or surcharges, the price shown is the price you pay.

We only provide pricing in $NZD, we do not support other currencies.

 

PRODUCTS

Sometimes the photo shown on the website may be slightly different to the actual product due to variations between shipments.

We will do our utmost to ensure that products only remain listed on our website while they are available.  However due to high demand or other unforeseen circumstances products may become temporarily unavailable.  If this should happen we will contact you to arrange either a replacement or full refund of product price.

 

DELIVERY POLICY

Products will be shipped via NZ Post.

We will aim to dispatch your parcel as soon as possible and expect that you would receive your parcel within 7 working days of your payment having been processed.  Please contact us via email at sales@equine9.co.nz if you have not received your parcel within this time.

 

RETURNS POLICY

If you are not completely satisfied with the product you receive, you have 9 weeks to return it to us (unused, in the same condition as when you received it and in the original packaging with proof of purchase) for a full refund of the purchase price of the goods.

If posting goods back they must be returned to us via New Zealand Post Parcel Post. If return postage costs are deemed to be our responsibility due to faulty goods we will credit the return freight as per New Zealand Post Parcel Post only.   Defective items are required to be returned first so that they are able to be assessed.

We will meet our responsibilities under the Consumer Guarantees Act 1993, provided however that if you are purchasing the product for the purposes of a business, you agree that the Consumer Guarantees Act does not apply, and, to the maximum extent permitted by law, our liability to you, or anyone claiming through you, will be limited at all times to the purchase price of the product to which your claim relates.

 

SHIPPING POLICY

Our shipping fee only applies to orders shipped to a New Zealand address.

Please contact us to obtain pricing for shipping to addresses outside of New Zealand.

 

PRIVACY

We commit to do our utmost to provide secure transactions.

We will not sell, trade, give or even loan your personal information to others.

We will only release account and other personal information if we believe release is appropriate to comply with law; facilitate court proceedings; enforce or apply our terms and conditions; or protect the rights, property, or safety of Equine9 Limited, our users, or others.

Where you have subscribed to Equine9 Limited or where you have provided your email address in the course of placing an order you have authorised us to retain your contact information and to contact you by email to advise you of offers being advertised on the site. You may advise us at any time that you no longer wish to receive emails from Equine9 Limited by emailing us at louise@equine9.co.nz and upon receipt of such advice we will remove your email address from our mailing list.

 

LIMITATION OF LIABILITY

Except to the extent expressly set out in these Terms you acknowledge that Equine9 Limited will not be liable for any damage, loss, cost, claim or expense arising out of or relating to:

(a)       The supply of products to you except to the extent expressly set out in these Terms; or

(b)       Your use of this site or any ‘hot linked’ site, or

(c)        Your use of or reliance on information contained in or accessed through this site.
To the maximum extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is hereby excluded. This disclaimer does not attempt or purport to exclude liability under statute if, and to the extent, such liability cannot be lawfully excluded (such as under the Consumer Guarantees Act 1993).

Subject to the other express provisions of these Terms, the maximum liability of Equine9 Limited to you for any claim relating to the supply of goods pursuant to these terms shall be limited to the value of those goods supplied.

 

CANCELLATION POLICY

Please note that once an order has been placed, we are not able to cancel the order.
